Agreement
These Terms of Service ("Terms") are between you and Jackson Davis ("Winsday", "we", "us"). By creating an account or using the Winsday app, you agree to these Terms and the Official Rules.
The service
Winsday is a free daily prize draw: watch sponsored ad plays to earn tickets, and at midnight UTC one ticket is drawn at random to win a real cash prize. Free to play — no purchase necessary. Contest details are in the Official Rules, part of these Terms.
Accounts
You must be 18 or older. One account per person — creating multiple accounts may lead to disqualification and termination. Keep your contact information accurate and current. You can delete your account at any time in the app (open the Wallet tab and tap Delete account in your Account section); see the Privacy Policy for what happens to your data.
Acceptable use
You agree not to: use bots, scripts, automation, or emulators to play; create multiple accounts or play on behalf of others; tamper with or reverse engineer the app or our systems; exploit bugs, errors, or glitches; report them instead; harass or harm other players; or use Winsday for any unlawful purpose.
Fair play
Winsday is built on fairness. We monitor play for cheating — bots, automation, multiple accounts, manipulation. If we find it, we may disqualify you, remove tickets, withhold or revoke prizes, and terminate your account. Disqualified prizes may be re-awarded to the next eligible player. Our cheating decisions are final, subject to the dispute provisions below.
Prizes and taxes
Prizes are described in the Official Rules. All taxes on a prize are yours. We may require tax information before paying; US winners receive tax forms when required (typically at $600 or more in winnings per year). Prizes are paid through a third-party payment vendor.
Our content
The app, its design, and its content belong to us and our advertisers. We give you a personal, non-commercial right to use the app. Don't copy, republish, or resell it.
No warranty
Winsday is provided "as is" and "as available", without warranties of any kind, express or implied. We do not promise it will be uninterrupted or error-free, or that you will win anything.
Limitation of liability
To the maximum extent permitted by law: we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data. Our total liability to you is limited to the greater of $100 or the prizes you won and received in the prior 12 months. Nothing limits liability that cannot be limited by law.
Changes to these terms
We may update these Terms from time to time. We will post the updated version in the app and, for material changes, notify you before they take effect. Continuing to use Winsday means you accept the updated Terms. If you don't agree, you can delete your account.
Termination
You may stop using Winsday and delete your account at any time. We may suspend or terminate your account if you violate these Terms or the Official Rules.
Governing law and disputes
These Terms are governed by the laws of New York. Any dispute will be resolved in the state or federal courts located in New York County, New York.
